A lender is legally entitled to begin repossession proceedings for its collateral security after a borrower has missed three consecutive mortgage payments. In reading the mortgage document, within it will be found a section entitled "Mortgage Indenture" which outlines (among other things) the lenders right to repossess its collateral security for non-payment. Think about it this way, until a borrower has paid-off the mortgage to the lender, the lender has a superior claim over the collateral security (i.e. the home) than the borrower, and reserves the right to repossess it under certain circumstances. Ultimately, lenders would prefer to receive the interest on the money loaned to you rather than taking your home. Afterall they are not realtors, but are in the lucrative lending business.
